TERMS AND CONDITIONS

Please read all these terms and conditions carefully.

Secure Payments
We use Shopify Payments to process orders securely. All transactions are encrypted using industry-standard SSL (Secure Socket Layer) technology. Our site is also PCI DSS compliant, a Payment Card Industry standard designed to protect your payment data. This means your card information is processed safely and is never accessible to us.

Intellectual Property Rights
We are the owner or licensee of all intellectual property rights in our website, products, and materials published on it. These works are protected by copyright, trademark and design rights. All such rights are reserved. You may print or download extracts from our site for personal reference, provided you acknowledge us as the source. None of our materials, imagery or designs may be used for commercial purposes without our written permission.

Amendments
We may update these Terms and Conditions from time to time. The version in force at the time you place your order will apply to that purchase.

1. APPLICATION

1.1 These Terms and Conditions apply to the purchase of goods by you (the “Customer” or “you”).
1.2 We are Art of Ping Pong Ltd (the “Supplier”, “we”, or “us”).
1.3 By ordering any of our goods, you agree to be bound by these Terms and Conditions.

2. INTERPRETATION

  • Consumer: an individual acting for purposes wholly or mainly outside their trade, business, craft or profession.
  • Contract: the legally binding agreement between you and us for the sale and purchase of goods.
  • Delivery Location: the address specified in your order where the goods are to be delivered.
  • Goods: any goods we supply to you, as described in the order.
  • Order: your order for goods submitted via our website or otherwise accepted by us.

3. GOODS

3.1 Product descriptions and images are illustrative only. Colours, finishes and packaging may vary slightly.
3.2 Where goods are made to your specification, you are responsible for ensuring the information you provide is accurate.
3.3 Our products may cause personal injury, property damage or break easily if not handled, positioned and installed with care.
3.4 Safe use of ArtTables:

  • ArtTables are conceived as artworks that can also be used as a fun ping pong table.
  • They are not engineered to be load-bearing and must not be used as seats, benches, or occasional tables.
  • ArtTables include moving parts. Take care when folding the legs and keep fingers clear.
  • These products are not toys and are not suitable for young children.
  • Please follow all instructions provided with your order.

4. BASIS OF SALE

4.1 Information on our website, brochures or catalogues does not constitute a contractual offer.
4.2 Our order process allows you to check and amend errors before submission.
4.3 We may reject an order for any reason, but will notify you promptly if this happens.
4.4 If a product is unavailable or incorrectly priced, we will inform you and refund any payment made.
4.5 Any variation to the contract must be agreed in writing by both parties.

5. PRICE AND PAYMENT

5.1 Prices are as listed on our website or otherwise agreed in writing.
5.2 All prices include applicable duties and taxes.
 • For UK customers, prices include UK VAT.
 • For international customers, duties and import taxes are already incorporated into the product price to ensure no additional payments are due on delivery.
5.3 For any bespoke made-to-order items, payment must be received in full before production begins.

6. DELIVERY

6.1 We will deliver goods within the timeframe stated on our website or order confirmation. For ArtTables, this may be up to two weeks from order to dispatch.
6.2 We ship worldwide. All duties and import taxes for international deliveries are included in the product price, so there are no customs fees payable on arrival.
6.3 If delivery cannot be completed due to circumstances within your control, we may charge reasonable costs for storage or redelivery.
6.4 Goods become your responsibility upon delivery. Please check items on receipt where reasonably practicable.

7. RISK AND TITLE

7.1 Risk of damage to, or loss of, the Goods will pass to you when the Goods are delivered to you.
7.2 Ownership passes only once payment has been received in full. If payment is overdue, we may cancel delivery and request the return of goods not yet paid for.

8. LIABILITY

8.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any matter where it would be unlawful to do so.
8.2 Except as required by law, we are not liable for:

  • losses that were not reasonably foreseeable at the time the contract was made;
  • losses to your business, trade, craft or profession (for example, loss of profit).

8.3 We accept no liability for damages or injuries arising from the incorrect assembly, installation or misuse of our products.
8.4 Except as required by law, our aggregate liability to you for any loss or damage arising out of or in connection with your order will not exceed the total price paid for the product in question.

9. WARRANTY

9.1 Our products are supplied with the guarantees required by law under the Consumer Rights Act 2015: they will be as described, of satisfactory quality and fit for purpose.
9.2 This does not affect your statutory rights.
9.3 We do not provide additional warranties unless expressly agreed in writing.
9.4 Commercial use: Our products are designed for residential/light use. Where used in commercial settings (e.g. offices, hospitality), warranty cover may differ. Please contact us to discuss suitable arrangements.

10. GOVERNING LAW, JURISDICTION AND COMPLAINTS

10.1 These Terms (and any non-contractual matters) are governed by the law of England and Wales.
10.2 Disputes may be brought in the courts of England and Wales, or if you live in Scotland or Northern Ireland, in your local courts.
10.3 We aim to resolve disputes quickly. Please contact us at studio@theartofpingpong.co.uk and we will respond within 5 working days.
